7. RULES OF RACING

1.Rule 47 of the Rules of Racing has been amended to read:

The list of entries shall be closed at the advertised time and no entry shall be admitted on any ground after that time-except where there are six or less entries received by the closing time-in which event the race shall be re-opened for a period of 48 hours. The relevant Race Club shall immediately advise all trainers of the re-opening of the race and shall also publicise the fact on the Club’s website”

This amended Rule came into effect on 1st May 2009


2.In future the Rules of Racing for the Channel Islands will be recorded on the Jersey Race Club’s website rather than in book form. Any amendments to the Rules will be communicated to the members and trainers by fax or e-mail and highlighted at the start of the website. The amendents will be subject to ratification at the subsequent Annual General Meeting of the Channel Islands Racing and Hunt Club.

9. STEWARDS’ ENQUIRIES

May 25th

The Stewards interviewed Mr Adam Jones- the rider of MOBUS WAN about the lack of effort he had made on the horse in the concluding stages of the race. They noted his explanation that he had not been ready at the start which had left the horse a lot to do to catch up. Once in the straight the horse had nothing left.


The Stewards enquired into possible interference in the fourth race but having viewed the video of the race decided that there had not been any.

The Stewards cautioned Mrs. Le Brocq-trainer of WALL STREET RUNNER-about the timing of her fitting ear plugs to the horse. This had been unsuccessfully attempted when the other horses had left the paddock and had taken time before she had decided not to use them, thereby delaying the start of the race.

June 7th

The Stewards interviewed A.Jones-the rider of STRATN JACK-regarding his horse running through the wing of a hurdle and off the course. They noted his explanation that he was trying to keep the horse straight by running alongside the rail but the horse had been too headstrong and had run out.

The Stewards interviewed V.Slattery-the rider of WALL STREET RUNNER-as to the horse’s behaviour when jumping the final hurdle. They noted his explanation that the horse was tired after a hard race and although he had held the whip in his right hand the horse had still jumped right. The Stewards decided that no blame could be attributed to the jockey but noted that the incident could have been worse if the eventual second-HIGH OCTAVE-had not jumped the hurdle so well. The Stewards decided that there had been no interference.

The Stewards held an enquiry to establish whether MOBUS WAN had started in the second race. The Starter advised the Stewards that the horse had not started and the appropriate announcement was made.

June 19th

The Stewards interviewed E.Stack-rider of SECRET ASSASSIN-about his riding of the horse-in that he did not appear to have ridden it out to obtain the best possible placing. They noted his explanation that the horse had run too freely and had nothing more to give in the final furlong.

July 4th

The Stewards interviewed Miss V.Lucas as to the reasons for one of her horses entering the paddock wearing the wrong number and another wearing the cap of a different colour to that in the race card. They noted her explanation that she had been very short of staff and both her jockeys had made mistakes. The Stewards cautioned her with regard to her future conduct in this respect.

July 19th

The Stewards enquired into the fall of ACROPOLIS but having interviewed the
Rider-V.SLATTERY-accepted his explanation that the horse had caused the problem by not putting his foot down. The Stewards noted with approval the speed at which the medical and veterinary officers had moved to reach the jockey and the horse.


Having received a report from the Starter that MAJESTICAL’s handler needed further training in handling the horse at the start, the Stewards advised
Mr. Stephen Arthur-the trainer accordingly.


Following a very unsatisfactory start to the fourth race the Stewards interviewed the Starter and received representations from an owner and two of the riders involved in the race. Having considered the matter and having heard from a Steward who had been at the Start, the Stewards advised the Starter that in all the circumstances they would have considered it more prudent for him to have recalled the runners and restarted the race. The Starter stated that with hindsight he accepted this recommendation.

August 2nd

The Stewards interviewed A. Jones- the rider of MOBUS WAN-who had refused to start and noted his explanation that following a certain amount of delay at the start the horse had dug his heels in and had simply refused to participate. There was nothing more that he as jockey could have done. This explanation was noted.

The Stewards subsequently considered the warnings that had been given over the years to Mrs. Malzard- the trainer of the horse- about the horse’s behaviour at the start. They had taken its recent conduct into account but recommended that should there be future problems the Stewards of the day should give the trainer a final warning about his future participation in any races in the Channel Islands.

August 16th

The Stewards interviewed Amy Baker-rider of FLIGHTY FELLOW-about her sustained use of the whip when the horse appeared out of contention. The Stewards noted her explanation that he is a big horse who had taken a long time to get into his stride and she had thought he would stay on if she had continued with the whip. When she realised he was not responding she had stopped.

The Stewards interviewed Emmett Stack-rider of CRYSTAL REIGN-about his high whip action a furlong and a half from the finish. On watching the video it was noted that when the jockey had pulled the whip through from his right to his left hand he had not used the same action whilst in contention to win the race. The Stewards noted his explanation that due to the dolling out he had less room than he had expected to allow his arm to perform the whipping action.

The Starter reported that on at least 3 occasions horses had been led into the start without any request having been made. The Stewards ruled that in future a request must be made to the Stewards who will inform the Starter accordingly.
Any request for to a horse to be led in will be considered by the Stewards and if
approved the horse will be led in from the second row to avoid incidents.

7. RULES OF RACING
The Stewards of the Channel Islands Racing and Hunt Club have approved
the following amendments to Instruction C of the Rules of Racing;

Clause 3
Insert at the end of the first paragraph:

With effect from the 2009 season, no application for a rider’s licence will be approved unless it is accompanied by a medical questionnaire (available from the Secretaries of the Jersey and Guernsey Race Clubs) completed by the applicant’s general practitioner. The questionnaire will be valid for 5 years and in the absence of exceptional circumstances will only need to be renewed after that time. The applicant must also complete an annual declaration of health. Having reviewed the completed questionnaire and the declaration of health, the Stewards of the C.I.R.H.C may at their complete discretion, require the applicant to undergo a medical examination by a medical officer approved by the Stewards of the C.I.R.H.C before issuing the licence,


Insert in paragraph 4 before the last sentence:

With effect from the 2009 season an applicant’s first application for a licence under this paragraph must be accompanied by the duly completed medical questionnaire described in the first paragraph. This will also be valid for 5 years. The declaration of health will also be required annually. Only in exceptional circumstances will the Stewards of the day issue a licence to an applicant who has not complied with this Instruction. In this event they will require the applicant to be examined by the Medical Officer on duty at the Course before they authorise the issue of a licence.

published in the 2007 Racing Calendar.

9. POSTPONEMENT OF MEETING
The Stewards of the Channel Islands Racing and Hunt Club gave permission
to the Jersey Race Club to postpone the meeting scheduled for March 24th until March 30th in view of the extreme weather and damage this had caused.

10. STEWARDS' ENQUIRIES

March 30th
The Stewards interviewed Mr A. Le Brocq-the trainer of HAMILTON HOUSE with regard to the horse’s unruly behaviour in the paddock and advised him that the horse’s future conduct would be closely monitored. They also cautioned the trainer as to his future conduct in the Stewards’ Room

The Stewards interviewed Mrs Malzard-the trainer of CLAN A CHIEFTAIN about the horse’s unruly behaviour in the paddock. They noted her explanation that this was the horse’s first run in Jersey and she had not known how the horse would behave. As trainer she would be responsible for parading the gelding on his next appearance.

The Stewards interviewed Mr. J S O Arthur- trainer of RETURN OF THE FAIRY as to the reasons for the filly being a non-runner. They noted and accepted his explanation that there had been a considerable change in the going
since declaration day and he was concerned that the filly who is a small horse would not be able to stay the distance in the testing ground.

The Stewards expressed a general concern that horses were consistently arriving late in the paddock and trainers must improve their punctuality throughout the season.


April 13th
The Stewards interviewed Mr. J.S.O. Arthur-the trainer of HIGHLAND FLIGHT-about the mare’s performance in the paddock when she had played up.
They noted his explanation that she might have been spooked by the direction of the loudspeakers. (Subsequent inspection suggested it was probable that it was the volume rather than the direction that had caused the problem).

The Stewards interviewed Mrs Malzard-the trainer of CLAN A CHIEFTAIN-
with regard to the gelding unseating his rider at the start and then doing a circuit of the track. They noted her explanation that the horse’s jockey had told her that the gelding had been kicked at the start and it was this that had caused the problem.

Two jockeys-Messrs Procter and Jones-requested a meeting with the Stewards
when they expressed their concern with the conditions of the race without whips. They suggested the conditions be changed on safety grounds to allow riders-as in England-to carry whips but only to use them in an emergency.
The Stewards considered this request and advised the jockeys that they were unable to change the conditions of the race which had been clearly set out in the Race Bill and which had been the basis of the trainers-the jockeys’ employers-entering their horses. The Stewards would however suggest to the Jersey Race Club that if they were to hold another race without whips in 2009,
they should reconsider the conditions of the race.

May 26th
The Stewards interviewed Messrs Jones and Batchelor-jockeys- after they had received a report from the Starter that they had used foul language when they jumped the first hurdle. The jockeys both acknowledged their use of the language and the Stewards informed them that this was unacceptable and would not be tolerated in future. The jockeys noted this and agreed to report the Stewards’ decision to the other jockeys riding at the meeting.

The Stewards interviewed Mr. E. Stack-the rider of KRISTINOR and Mr. T.O’Brien-the rider of CULZEAN BAY after both horses refused to start after coming under Starter’s Orders. Mr Stack explained that his horse simply did not want to start and had ‘planted’ his feet. Mrs Malzard-the trainer of both horses- said she was unable to explain the horse’s behaviour since it was the first time that it had acted in this way. Mr. O’Brien stated that he had not been able to get his horse close to the starting tape. Mrs Malzard stated that it was the horse’s first run for her in Jersey and that she was a bit mareish and the behaviour had not been anticipated. The trainer stated she would be more vigilant in future and she would not run the horses in the same race again. These explanations were noted.

The Stewards noted in the fourth race that four horses had not been ridden out to obtain their highest possible placings-albeit for minor positions. The Stewards noted that the leniency shown in not penalising the jockeys on this occasion
should not be taken as a precedent for the remainder of the season and reminded trainers that it is their responsibility to ensure that instructions given to jockeys confirm this.

June 13th
The Stewards interviewed Mr. E. Stack-the rider of CULZEAN BAY-after the horse refused to start after coming under Starter’s Orders. The rider explained the horse had simply ‘not wanted to know’. Mrs Malzard-the trainer-stated that she been to the course with the horse prior to the meeting and had run trials with
the loudspeakers. In view of the horse’s behaviour the Stewards decided to give the horse one final chance to perform.

The Stewards interviewed Mrs Malzard-the trainer- after two of her horses were late into the paddock. Mrs Malzard was unable to offer any satisfactory explanation. The Stewards found this behaviour unacceptable-especially in the light of a general precautionary warning to all trainers at the first meeting of the
year and stated that future timekeeping would be closely monitored.

The Stewards interviewed Mr. N Guilbert-the rider of HIGH VOLTAGE-about his use of the whip in that he had hit the horse with excessive frequency without giving the horse time to respond and had raised the whip above shoulder height.
The jockey offered no explanation for his actions and was cautioned by the Stewards who advised him that his future rides would be closely monitored.

The Stewards interviewed Miss Rasdall-trainer of GABBY HAYES-about the horse’s late entry into the paddock. As she was unable to offer any satisfactory explanation, the Stewards cautioned her as to her future conduct and warned her that her performance would be closely monitored at future meetings.

June 27th
The Stewards interviewed Mr. Ephgrave-the trainer of ANEMIX-the winner-with regard to the horse’s improvement in form. They noted the trainer’s explanation that the improvement was due to fitness. The horse had not run at a previous meeting and had needed the run last time out.

The Stewards interviewed Mr. A. Daly-rider of KRISTINOR-after the horse had refused to start after coming under Starter’s Orders. The rider stated that the horse ‘had not wanted to know’. Mrs. Malzard-the trainer could offer no explanation except that the horse was quirky and had ability when he ran. In view of the horse’s behaviour the Stewards decided to give the horse one final chance to perform.

July 13th
The Stewards interviewed Mr. V. Slattery- the rider of PRETTILINI- into why he had failed to ride to the finish. The rider stated that he had given the horse every opportunity but on entering the straight it was clear to him that the horse did not act on the firm going; accordingly he had felt it right to bring the horse home without any ill effects. This explanation was confirmed by the trainer who pointed out that she had informed the Stewards’ Secretary before the race that she was concerned about the going and that the horse would be eased if the going proved too firm for the horse. The Stewards noted the explanations and advised the trainer that the horse’s performance would be monitored in the future.

The Stewards interviewed Mrs. Le Brocq-the trainer of WALL STREET RUNNER-after the withdrawal of the horse. The trainer stated that her decision was based on the firmness of the going that had not been apparent at the date of declaration. The Stewards noted this explanation and fined the trainer the statutory amount of £50.

STEWARDS OF THE CHANNEL ISLANDS RACING AND HUNT CLUB
The Stewards of the Channel Islands Racing and Hunt Club met on July 24th to consider an appeal by Mrs. Le Brocq against the fine of £50 imposed upon her by the Stewards of the Jersey Race meeting on July 13th. Having heard evidence from Mr. David Picot-a Steward at the meeting-and Mrs Le Brocq
the Stewards allowed the appeal on the grounds that a horse had been allowed to be withdrawn without penalty earlier in the season. The Stewards did however caution Mrs. Le Brocq that if she had followed the correct procedures and requested a meeting with the full panel of Stewards, the problem might well have been avoided.

August 10th
The Stewards enquired into possible interference in the hurdle race. However having viewed a video of the race they concluded that the placings had not been affected.

The Stewards interviewed Miss. Lucas as to why she had withdrawn TOP PURSUIT. She explained that she had not been able to find a suitable jockey and the owners had not been willing to pay for a jockey to come over from the mainland for one race. Additionally there had been no non runners declared at the meeting which might have freed up a jockey. As a result she had no alternative but to withdraw the horse. The Stewards did not consider this as an acceptable reason for not running the horse and imposed the statutory fine of £50.

August 25th
The Stewards considered an objection from the Clerk of the Scales that
Mr.A. Jones- the rider of the winner KOKA FAST- had not weighed in. Having heard evidence from the Clerk of the Scales, her assistant and Mr. Jones they concluded that he had not weighed in correctly and therefore disqualified the horse and revised the placings accordingly

The Stewards enquired into possible interference in the final furlong of the last
Race but having viewed the video they concluded there had been none.

STEWARDS OF THE CHANNEL ISLANDS RACING AND HUNT CLUB

The Stewards of the Channel Islands Racing and Hunt Club met on 6th October to consider the report of the Stewards of the Jersey Race meeting held on 25th August when KOKA FAST had been disqualified as the winner of the Clarendon Cup due to his rider-Mr. A. Jones-failing to weigh in.

The Stewards wished to interview Mr. Jones to establish the reasons for his failing to weigh in. However Mr. Jones, despite being advised on three occasions of the date, time and place of the meeting had advised the Senior Steward that he would not be attending the meeting.

After discussing the matter the Stewards resolved that the appropriate sanction would be a fine and accordingly fined Mr. Jones £350 for failing to weigh in.
